This is Amnesty International’s submission to the call by the UN Working Group on Business and Human Rights, for their report on Indigenous Peoples’ Free, Prior and Informed Consent, Business and Human Rights. It draws on multiple researched case studies, and highlights inadequate domestic legal frameworks, manipulation of Indigenous representative institutions, prioritization by governments of economic – often extractive – development, failure to provide sufficient information on proposed projects, and the failure to genuinely aim to achieve consent as the outcome of consultation, among other issues.
